Batting Cage Waivers

ATHLETIC SPORTECH WAIVER FOR THE USE OF BATTING CAGE

I hereby acknowledge and agree that participation in the batting cages within Athletic SporTech LLC, a Baseball and Softball Training Facility has inherent risks. In consideration of the services provided by Athletic SporTech, their agents, officers, participants, consultants, employees and all persons or entities acting in any capacity on their behalf (hereinafter referred to as Athletic SporTech) I now agree and certify as follows:

1. I acknowledge and fully understand that I, __________________________________________, the participant (if participants is 18 years of age or older) or parent/legal guardian of the above listed minor participant, will be engaging in activities that may involve risk of serious injury which might result not only from my own actions, inactions, or negligence, but from the actions, inactions, or negligence of others or the conditions of the premises or of any equipment used. Further, that there may be other risks not known or not reasonably foreseeable at this time. The risks may include, but are not limited to: nature of the activity, latent or apparent defects of conditions in equipment or property supplied by Athletic SporTech or other entity; acts of other participants in this activity, employees or agents of Athletic SporTech; my own physical condition, acts of omissions; conditions of Athletic SporTech facility and surrounding grounds or terrain and accidents connected with their use; first aid emergency treatment or other services.
2. I expressly agree and promise to accept and assume all the risks existing in this activity. My participating in this activity is purely voluntary and I elect, in spite of the risks, to participate. I assume all the foregoing risks and accept personal responsibility for the damages following such injury.
3. On behalf of myself, my children, my parents, my heirs, assigns, personal representative I hereby voluntarily release, waive, forever discharge, and agree to indemnify and hold harmless Athletic SporTech and each of their respective commissioner, directors, agents, and other employees, its parent, subsidiaries, affiliate, employees, distributors and agents, other batting cage participants, and if applicable, operator or lessors of premises used to conduce the event/activity, from any and all liability for any and all claims, demands of causes of action which are in any way connected with my participation in this activity or my use of Athletic SporTech equipment or facilities.
4. I hereby certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in these activities or alternatively I agree to bear the cost of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risk that may be created, directly or indirectly, by any such condition.
5. I hereby certify that I am at least 18 years old, or the part or legal guardian of the participant under 18, and I agree I will wear a batting helmet at all times while in the batting cages. I hereby provide Athletic SporTech permission to administer basic first aid and I authorize Athletic SporTech or its agents or employees to contact 911 or other emergency personnel as needed.
6. I hereby certify that I have been given the Rules & Regulations for batting cage use and will adhere to them.
7. I do hereby give Athletic SporTech its assigns, licensees, and legal representatives the irrevocable right to use photographs or video in all forms and media and in all manners, including composite, for advertising or marketing for publication or any other lawful purposes, and I waive any right to inspect or approve the finished product, including written copy, internet, etc., which may be created in connection therewith.

By signing this document, I acknowledge that if anyone is hurt, or property is damaged during participation in this activity a court of law may find me to have waived my right to maintain a lawsuit against Athletic SporTech and each of the parties listed in Paragraph 3 above on the basis of any claim from which I have release them herein.

I HAVE HAD SUFFICIENT TIME TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS. THIS WAIVER WILL BE VALID FOR THE TERM OF 12 MONTHS.

By clicking and accepting the box for this waiver and release of liability and by completing the on-line registration process, you agree on behalf of yourself, your successors, heirs, assigns, executors and administers as described earlier.

RELEVO DE RESPONSABILIDAD PARA EL USO DE CAJA DE BATEO EN ATHLETIC SPORTECH

Por la presente reconozco y acepto que la participación en el campo de bateo en las facilidades de Athletic SporTech LLC, una tienda deportiva tiene riesgos inherentes. En consideración a los servicios proporcionados por Athletic SporTech, sus agentes, oficiales, participantes, consultores, empleados y todas las personas o entidades que actúen en cualquier capacidad representando a Athletic SporTech, acepto y certifico lo siguiente:

1. Reconozco y entiendo completamente que yo, __________________________________________, el participante (si el participante tiene 18 años de edad o más) o el padre / tutor legal del participante menor mencionado anteriormente, participaré en actividades que pueden implicar riesgo de lesiones graves que podría resultar no solo de mis propias acciones, inacciones o negligencia, sino de las acciones, inacciones o negligencia de otros o de las condiciones de las instalaciones o de cualquier equipo utilizado. Además, puede haber otros riesgos desconocidos o no previsibles razonablemente en este momento. Los riesgos pueden incluir, pero no se limitan a: naturaleza de la actividad, defectos latentes o aparentes de las condiciones en el equipo o propiedad suministrada por Athletic SporTech u otra entidad; actos de otros participantes en esta actividad, empleados o agentes de Athletic SporTech; mi propia condición física, actos de omisión; condiciones de las instalaciones de Athletic SporTech y terrenos o terrenos circundantes y accidentes relacionados con su uso; tratamiento de emergencia de primeros auxilios u otros servicios.
2. Acepto y prometo expresamente aceptar y asumir todos los riesgos existentes en esta actividad. Mi participación en esta actividad es puramente voluntaria y elijo, a pesar de los riesgos, participar. Asumo todos los riesgos anteriores y acepto la responsabilidad personal por los daños derivados de dicha lesión.
3. En mi nombre, mis hijos, mis padres, mis herederos, cesionarios, representante personal, por la presente libero voluntariamente, relevo de toda responsabilidad y acepto indemnizar y eximir de responsabilidad a Athletic SporTech y a cada uno de sus respectivos comisionados, directores, agentes, y otros empleados, su matriz, subsidiarias, afiliadas, empleados, distribuidores y agentes, otros participantes del campo de bateo y, si corresponde, el operador o arrendadores de las instalaciones utilizadas para conducir el evento / actividad, de cualquier y toda responsabilidad por cualquier reclamo, demandas de causas de acción que están de alguna manera conectadas con mi  participación en esta actividad o mi uso del equipo o  instalaciones de Athletic SporTech.
4. Por la presente certifico que tengo un seguro adecuado para cubrir cualquier lesión o daño que pueda causar o sufrir mientras participo en estas actividades o,  lternativamente, acepto asumir el costo de dicha lesión o daño yo mismo. Además, certifico que no tengo condiciones médicas o físicas que puedan interferir con mi seguridad en esta actividad, o de lo contrario estoy dispuesto a asumir y asumir los costos de todo riesgo que pueda ser creado, directa o indirectamente, por tal condición.
5. Por la presente certifico que tengo al menos 18 años de edad, o la parte o el tutor legal del participante menor de 18 años, y acepto que usaré un casco de bateo en todo momento mientras esté en el campo de bateo. Por la presente otorgo permiso a Athletic SporTech para administrar primeros auxilios básicos y autorizo a Athletic SporTech o sus agentes o empleados a comunicarse con el 911 u otro personal de emergencia según sea necesario: Apellido, Nombre, Inicial, Fecha de Nacimiento, Dirección, Pueblo, País, Código Postal, Teléfono, Email.
6. Por la presente certifico que se me han dado las Reglas y Regulaciones para el uso del campo bateo y que las cumpliré.
7. Por la presente otorgo a Athletic SporTech a sus cesionarios, licenciatarios y representantes legales el derecho irrevocable de usar fotografías o videos en todas las formas y medios y en todas las formas, incluyendo compuestos, para publicidad o marketing para publicación o cualquier otro propósito legal, y Renuncio a cualquier derecho de inspeccionar o aprobar el producto terminado, incluida la copia escrita, Internet, etc., que pueda crearse en relación con el mismo.

Al firmar este documento, reconozco que, si alguien se lastima o la propiedad se daña durante la participación en esta actividad, un tribunal de justicia puede encontrar que he renunciado a mi derecho a mantener una demanda contra Athletic SporTech y cada una de las partes enumeradas en el párrafo 3. anterior sobre la base de cualquier reclamo del que los haya liberado en este documento.

HE TENIDO SUFICIENTE TIEMPO PARA LEER ESTE DOCUMENTO COMPLETO. LO HE LEÍDO Y COMPRENDIDO, Y
ACEPTO ESTAR OBLIGADO POR SUS TÉRMINOS. ESTE RELEVO DE RESPONSABILIDAD SERA VALIDO POR EL TERMINO DE 12 MESES.
